Acceptance of Terms Of Service: MYCHURCHSITE.COM provides its Service(s) to you, subject to the following terms of Service ("TOS"), which may be updated by us from time to time without notice to you. Acceptance of the TOS is required for use of our Service(s).
Service(s): Service(s) consists of website hosting and a restricted license to use the MYCHURCHSITE.COM content management system on said hosted website. Unless specifically stated otherwise, any new feature(s) that are added, shall be subject to the TOS. In order to use the MYCHURCHSITE.COM Service(s), you must obtain your own access to the Internet. Associated fees or costs may be incurred through such access and are not covered by the Service(s) provided. In addition, you must provide your own equipment necessary to make such connection to the Internet, including a computer and modem or some other access device.
License:
1. You acknowledge and agree that the Service(s) provided to you by MYCHURCHSITE.COM contain(s) software code that is proprietary and confidential information; protected by applicable intellectual property laws and statutes. Though stored on a server accessible to the public, it is not available for download nor is it permissible to transfer the code, or any part thereof, to any other server or computer.
2. MYCHURCHSITE.COM grants you a non-transferable and non-exclusive license to use its Service(s) and the associated software and code, provided that you (or someone you grant access to) do not, or even make attempt to, discover, copy, modify, create a derivative work of, reverse engineer, distribute, resell, sublicense or make available to an outside party, any part of our proprietary software code base.
Payment: Payment options include prepayment for an annual term, a six-month term, or a monthly term. Without regard to which payment option you choose, billing will commence with the establishment of your account and continue on the 1st day of each subsequent billing cycle. Payments are to be made within thirty (30) days of invoicing. Payment can be made via credit card or check. Invoices not paid within thirty (30) days are considered late and past due and subject to lates fees, account suspension and/or cancellation:
1. Accounts more than thirty (30) days past due will be assessed a $5 late fee.
2. Accounts more than sixty (60) days past due will be suspended, preventing visitors to website from viewing content. Email service and account login may also be suspended.
3. Accounts more than ninety (90) days past due will be deleted and any unpaid amount may be turned over to a collection agency.
Cancellation: If for any reason you are unhappy with the Service(s) provided by MYCHURCHSITE.COM, you are free to cancel your service at any time. If your account is in good standing, and all payment(s) have been received by us for Service(s) rendered to you, we will return to you a prorated refund calculated using the monthly rate for Service(s) not yet received. Domain name registrations require cancellation at least 60 days prior to their annual renewal date.
Conduct: You agree to be bound by the following terms and limitations of the MYCHURCHSITE.COM Service(s):
1. You shall not use our hosting or email services to store, post, promote, link to or otherwise involve any of the following:
  1. Content that is pornographic, illicit or offensive in nature.
  2. Content that is illegal, libelous or of a defamatory nature.
  3. Content that is of a racist, or hateful nature.
  4. Content that is an infringement or misuse of any copyright, patent, trademark or other protected material.
  5. Warez, hacks, cracks or any other illegally obtained software.
  6. Content that attempts to defraud the public.
2. You agree not to use our Service(s) to:
  1. Participate in chain letters.
  2. Impersonate another person.
  3. Misrepresent your identity and/or purpose.
  4. Send spam email, or any other unsolicited or unwanted offers, services and/or products.
3. You understand and agree that it is your responsibility:
  1. To protect the password provided to you by MYCHURCHSITE.COM for access to our Service(s), and only provide it to trusted persons.
  2. To notify us immediately should your account or password become compromised.
4. You agree that you are solely responsible for the content posted on your website, and that you may be legally liable for said content.
Notice to Law Enforcement: If for any reason we determine that law enforcement officials need to be notified regarding potentially illegal content posted on your website, you agree and understand that we may provide copies of said content to the proper authorities without your consent or notice to you. We will cooperate fully with the efforts of law enforcement agencies to identify or locate persons responsible for posting illegal content.
Termination: You agree that MYCHURCHSITE.COM, in its sole discretion, may terminate your account, password, website and/or use of its Service(s), and remove and discard any of your content, for any reason, including, without limitation, if MYCHURCHSITE.COM believes you have violated the letter or spirit of the TOS. You agree that termination of Service(s) under any provision of this TOS may be effected without prior notice to you, and further agree that MYCHURCHSITE.COM will not be liable to you or any other third-party for termination of your access to the Service(s).
Representations and Warranties: The Service(s) is provided to you without representation or warranties of any kind, either expressed or implied, without limitation.
1. Use of the Service(s) is at your own risk.
2. The Service(s) is provided on an “as is” and “as available” basis.
3. MYCHURCHSITE.COM makes no warranty that the Service(s):
  1. Will meet your requirements or needs.
  2. Be uninterrupted, timely, secure or free of bugs and/or flaws.
4. Any material downloaded through the Service(s) is done at your own risk and you are solely responsible for any damage to your computer or corruption of your software.
Indemnity: You agree to defend, indemnify, save and hold MYCHURCHSITE.COM harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees, that may arise or result from any service performed or agreed to be performed or any product sold by you, your agents, employees or assigns via the website and/or Service(s) we provide.
General:
1. The illegality or invalidity of any provision of this Agreement shall not impair, affect or invalidate the other provisions of this TOS.
2. The construction, validity, performance and effect of this Agreement shall be governed by Federal law, as applied by the Federal Courts in the State of California. Federal law and regulations will preempt any conflicting or inconsistent provisions in this TOS.
3. You agree to abide by all requirements, provisions and policies, along with amendments thereto, established by this TOS.
